Hello,

An open letter to anyone who may help those affected on Aug. 1st. I was one of those directly affected by the raids on Aug. 1st. I am hoping to join all those that were affected buy these raids together in support of each other. I am suggesting that we may possibly hire a single specialized attorney or law firm to represent us in fight any charges that may be filed against us. I have submitted an email listed below that I have sent to a couple of site owners that I believe were also affected. I am asking also for the help of your community and others in these efforts. We will most likely need to compile a list of these sites and company or contacts for them so that we may contact each other with ongoing information regarding our issues. I am also asking that a possible forum posting to help us all find a specialized law firm to defend us as well as a legal defense fund be set up for this law firm. It would be great if we could find a law firm that would offer their services at a reduced rate. Of course each of the defendants will each contribute to this fund as well. I believe that this may be the best and only way for us all to fight any charges that may be brought against us. I am not a rich man by any means. I live in a small house that is 19 years old and drive a 10 year old van. I am self employed and work alone. This is not some large business that has corporate jets to fly around in. The results of this raid may very well bankrupt me and I may have to start my life all over again. They have taken my life away from me and don't know what to do and this is way I am asking for any and all help. I have never personally done anything wrong. I do not modify any game consoles, install any modchips or sell, make, own, download, distribute or offer in anyway game copies, etc. My site has never condoned any illegal activities and warn everyone not to break any laws. My site has many disclaimers against using any products, software, etc. in any illegal manner and that we will not be held responsible if they do use any item in any illegal manner.
Please reply with any help or guidance you can offer us. We really need the help from you and the public community to fight these.
1) We need a list of the 32 that were raided.
2) We need a specialized law firm to help us.
3) Setup a legal defense fund and ask for community donations.
Those of us that were affected by the raids will each contribute to this fund and I will be the first to contribute, but I know that it will never be enough to fight any lengthy legal battle.

I am writing you because like yourself, I was also affected by the raids on Aug. 1st. I believe that all those that were affected would benefit by communicating with each other in exchanging any information that could help us all as a whole.
I have hired a local attorney to help me individually, but believe that all of us would benefit greatly to pursue the hiring of a specialized law firm attorney that would take us all on in a single case against the government. This is just an idea, but I believe from what I have read in the forums that the community would help us and rather than spending what money we have on a local attorney that may not be knowledgeable enough in the specific laws, we find one that is. We may even ask the community to help us in finding us one that is. Just thoughts, but again I believe we will need to help each other in this time of need.
There are potentially 32 separate individuals that could form a single alliance to fight against any charges levied against us in court. Think about it and let me know your thoughts.
Another idea is to start a blog site for us all. It could either be a closed or an open forum and could even ask for donations to our legal fund. We may even inquire of xbox-scene.com and other forum/community sites for some help.
I really think that we all have to come together to help fight this. If you know of any others that were affected directly by these raids I would ask of you to pass this information on to them as well.

The only way anybody can fight this is if they stand together... Honestly though, win or lose in court, anyone involved with this is screwed. Legal fees alone are going to put them on the street. Once the federal government sets their sites on you, they will do anything in their power to ruin you. I feel bad for everyone affected by these raids and wish there was something I could do for them.

I would think that if they found out you have a chip/softmodded, then they would come to your house. If they look on your hdd, and you own copies of all of the games on the hdd, then they should let you go, and if not your in trouble. Instead, they go after sellers.

Edit: Also, if the modder only installed the chip but didn't flash the bios, its not illegal for him. If you only put a chip in a xbox, it wont run any differen't than if you didn't have a chip in the xbox. So it all runs back to the bios, so some of those guys may have gotten off the hook.

The government is just trying to make a example and there going to make a harsh one at that. They dont care who they do it as long as it pays there Mercedes car payment and there house they dont care if they make poor people broke or not. We get so taxed on shit over here dam u go to court no matter what thats $75-100 just to step inside. serious the way they set everything up is like i been saying were the rich get richer and poor get poorer. ke a infinity of money but they dont do that cus they want us to work like robots for there fucking house payment or car or there fucking kids college right now im having a f#&@ in hard time just trying to get into college cus the way they have the government funds set up i have to get all this information and taxes of my parents i dont live with my dad is dead my mom maybe gets $400 a month from ssi and shes never filed taxes. The government says your a adult soon as u hit 18 well then why the f#&@ they making it feel like i have to be 24 just to get into college to try getting more money and a better life and also to pay another officials car payment. The government in my mind is fucked up and i dont care if it starts a war with someone else saying no its not thats your opinion and mines mine. There is so much more stupid shit that i can list that the government but ill just let it be.

Like i said mod chips should not be illegal unless used in a matter to put games on your hard drive that you dont own. Go after the People that are bootlegging Games and stop messing with regular people. Another thing is that all these gaming companys should be happy that there is people out there trying to make there consoles better then they are now even thow they are fuckin awesome now but we all ways want more.

We have way more problems in the world right now then messing with some modders.

this is hearting alot of people. even those who havent been raided. havent they tried this same crap in the uk, and aus? and what about the people who use there modchips to preserve the collection of games. like me!! or use it to allow them to use homebrew software and linux. which from what i have read of the dmca's big document of rules and digital laws. said we are allowed to do. i dont know but others in the usa. but this crap kinda makes you want to move over sees. as our government is so damn hipacritacal. they always seem to stick there foot in there mouths. is it illegal for us now to even do repairs?

This is bad...
They had a setup in Holland called BIGES ( Ban Illegal Games en/and Software).
They quit though because the laws in Holland are double crossing each other.
for example: you are allowed to have limewire or something similar and download music (without paying) what so ever and use it, but you couldn't put it on cd and sell it to somebody, you could actually put it on cd and give it to somebody but not sell it. same goes for all things like downloading a game for whatever system.
You could use it yourself without getting crapped by government but you could not put it on cd to sell it to somebody. which is ofcourse not righteous but happens.
Now i'm thinking am i being protected by the fact i'm living in a place with dutch laws and so am able to mod my xbox without problems...
Or are the Men in Black going to come to my house to for modding my xbox for what ever reason?
Now does this all mean that there will be no more mod selling/repairing stores in the US? i ordered mine from Canada, is Canada also going to be a target or are they still going to be free to actually keep distributing and saving there investments.
