I honestly don't think anyone is hacking bungie's servers just to unban some people from playing H2 on live.
As the co-admin I have never seen a post eluding to the fact that it is even possible. You may have seen these ramblings on another site.
As far as XBL bannings go, I am sticking to the theory that you basically can flip a coin as far as getting banned or making it on.
I just modded a 1.0 machine that had previously been on XBL. I installed a Xenium ice mod chip and a 200GB HD.
I used the account recovery method to get on XBL and all went fine. I then jumped off and back on to see if I would get banned, no problems to report.
