' The woman who was photographed was 17 during the shoot for The Guy Game ' Colleges everywhere must have been delighted when The Guy Game came out for the Xbox and the PlayStation 2. The trivia game was in the spirit of You Don't Know Jack where players use their brains and reaction times to win. As for the graphics, though, those were much more indebted to the Girls Gone Wild videos where coeds flash the cameras for a t-shirt. By mastering the trivia, players were rewarded with footage that was shot during spring break at South Padre Island. The only problem is that one of those women was underage at the time and is now suing the developer.

According to The Sun Herald, the lawsuit filed claims that this questions the legality of the game since the consent form that was filled out would be declared moot. The lawsuit requests that the game be pulled from distribution and a judge has granted a temporary restraining order that prohibits any copies of the game from being sold.

The defendants in the lawsuit include Topheavy Studios, the Austin developer who created the game, as well as its parent company, Gathering of Develpers, Inc. Also named in the suit are Sony Computer Entertainment America, Inc. and Microsoft Corp.

The reasons stated for the lawsuit are that the plaintiff has suffered humiliation, embarrassment, and shame since the release of the game.
